By accessing or using LearnEnergyAI ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

To access certain features of the Platform, you must create an account using Google OAuth authentication via Clerk. You agree to:

• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized account access

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree not to:

• Share your account credentials with others
• Create multiple accounts for fraudulent purposes
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

3.3 Age Requirement

You must be at least 13 years old to use the Platform. If you are under 18, you represent that you have obtained parental or guardian consent to use the Platform.

You agree not to use the Platform to:

• Violate any applicable laws, regulations, or third-party rights
• Upload, transmit, or distribute malicious software or harmful code
• Engage in any activity that disrupts or interferes with the Platform's functionality
• Attempt to gain unauthorized access to any portion of the Platform or other users' accounts
• Scrape, crawl, or use automated means to access the Platform without permission
• Reproduce, duplicate, copy, sell, or exploit any portion of the Platform for commercial purposes
• Post or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
• Spam, phish, or engage in any form of unsolicited communication
• Remove or modify any copyright, trademark, or other proprietary notices

Violation of this Acceptable Use Policy may result in immediate account termination and legal action.

5.1 Platform Content

All content on the Platform, including but not limited to text, graphics, logos, images, videos, software, and course materials ("Platform Content"), is the property of LearnEnergyAI or its content providers and is protected by copyright, trademark, and other intellectual property laws.

5.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial educational purposes.

5.3 Restrictions

You may not:

You may submit ratings, feedback, and other content ("User Content") to the Platform. You retain ownership of your User Content.

6.2 Content License

By submitting User Content, you grant LearnEnergyAI a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content for the purpose of providing and improving the Platform.

6.3 Content Responsibility

You are solely responsible for your User Content. You represent that your User Content:

• Does not violate any third-party rights
• Does not contain malicious or harmful content
• Complies with these Terms and applicable laws

6.4 Content Removal

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice.

7.1 "As Is" Basis

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 Educational Purposes

The content on the Platform is for educational and informational purposes only. It does not constitute professional advice and should not be relied upon as such. Always seek the advice of qualified professionals regarding specific industry applications.

7.3 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LEARNENERGYAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

7.4 Maximum Liability

Our total liability for any claims arising from or related to these Terms or the Platform shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the event giving rise to liability.

You agree to indemnify, defend, and hold harmless LearnEnergyAI, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content
• Your breach of any applicable laws or regulations

9.1 Termination by You

You may terminate your account at any time by contacting us or deleting your account through the Platform settings.

9.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Platform, with or without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Any other reason at our sole discretion

9.3 Effect of Termination

Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

10.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Platform shall be resolved through:

1. Informal Negotiation: First, contact us at legal@learnenergyai.com to attempt to resolve the dispute informally
2. Mediation: If informal resolution fails, the parties agree to attempt mediation
3. Arbitration: If mediation is unsuccessful, disputes shall be resolved through binding arbitration

10.3 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts located in Gurugram, Haryana, India for any disputes that cannot be resolved through arbitration.

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Effective Date" at the top
• Sending email notification for significant changes
• Requiring acceptance of updated Terms upon next Platform access for major changes

Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.
